This Arbitration Agreement requires that you and Peptide Circle HQ LLC resolve disputes through binding individual arbitration. You waive any right to participate in a class action lawsuit, class-wide arbitration, or jury trial. By purchasing any product or using our website, you agree to be bound by these provisions.
You and Peptide Circle HQ LLC ("Peptide Circle HQ," "we," "us," or "our") agree that any dispute, claim, or controversy arising out of or relating to your purchase of any product, your use of peptidecirclehq.net (the "Site"), the Terms of Sale, the Research Use Only Agreement, the Privacy Policy, or this Arbitration Agreement (each a "Dispute") shall be resolved exclusively through binding individual arbitration, except as expressly set forth in this Agreement.
This Arbitration Agreement applies broadly and is intended to cover any and all Disputes, including without limitation:
YOU AND PEPTIDE CIRCLE HQ AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, REPRESENTATIVE, MASS, OR CONSOLIDATED ACTION OR PROCEEDING. YOU AND PEPTIDE CIRCLE HQ WAIVE ANY RIGHT TO A TRIAL BY JURY.
Unless both you and Peptide Circle HQ agree otherwise in writing, the arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of class, collective, or representative proceeding. If this class action waiver provision is found to be unenforceable, then the entirety of this Arbitration Agreement shall be null and void, but the remainder of the Terms of Sale and other agreements between us shall remain in effect.
Before initiating arbitration, the party with a Dispute must first provide the other with a written Notice of Dispute that describes the nature and basis of the claim and the specific relief sought. Notices to Peptide Circle HQ shall be sent to:

The parties will attempt to resolve the Dispute informally for sixty (60) days following the Notice. If the Dispute is not resolved within this period, either party may commence arbitration.
The arbitration shall be administered by the American Arbitration Association ("AAA") in accordance with its Consumer Arbitration Rules (the "AAA Rules"), as modified by this Agreement. The AAA Rules are available at www.adr.org or by calling 1-800-778-7879. If the AAA is unavailable or unwilling to arbitrate, the parties shall agree on an alternative arbitration provider, and if they cannot agree, a court of competent jurisdiction shall appoint one.
The arbitrator shall have exclusive authority to resolve all Disputes, including any issue concerning the formation, scope, interpretation, applicability, enforceability, or waiver of this Arbitration Agreement. The arbitrator shall have authority to grant any remedy that would be available in court, including injunctive and declaratory relief, but only on an individual basis. The arbitrator's award shall be final and binding.
Arbitration shall be conducted in Sheridan County, Wyoming, or, at your election, via telephone, video conference, or written submissions for claims under $25,000. For claims exceeding $25,000, either party may request an in-person hearing in Sheridan County, Wyoming.
Each party shall bear its own attorneys' fees and costs except where the AAA Rules or applicable law require otherwise. The AAA Rules govern allocation of arbitration administrative fees and arbitrator compensation.
Notwithstanding the foregoing, the following Disputes are not subject to arbitration:
The parties shall keep all aspects of the arbitration, including the existence of the arbitration, all documents and information exchanged in the arbitration, and the arbitrator's award, strictly confidential, except as required by law or to enforce the award.
This Arbitration Agreement evidences a transaction in interstate commerce, and the Federal Arbitration Act, 9 U.S.C. ยง 1 et seq., shall govern the interpretation and enforcement of this Agreement. To the extent state law is applicable, the laws of the State of Wyoming shall govern, without regard to conflict of laws principles.
If any provision of this Arbitration Agreement is found to be invalid or unenforceable, that provision shall be severed and the remaining provisions shall remain in full force and effect, except that if the class action waiver in Section 3 is found unenforceable, then the entire Arbitration Agreement shall be null and void.
This Arbitration Agreement shall survive termination of any relationship between you and Peptide Circle HQ and shall apply to all past, present, and future Disputes.
You may opt out of this Arbitration Agreement by sending written notice of your decision to opt out to [email protected] within thirty (30) days of your first purchase. Your opt-out notice must include your full name, mailing address, email address, and a clear statement that you wish to opt out of the Arbitration Agreement. Opting out will not affect any other provision of the Terms of Sale or other agreements.
